While insurance is not legally mandatory for shipping, certain vessels have specific insurance requirements. Specifically:

 

General Shipping Businesses: No Mandatory Insurance Required. For ordinary shipping operations, the law does not mandate insurance. This means that whether transporting cargo or operating a vessel, businesses or individuals can decide whether to purchase insurance based on their risk tolerance, business needs, and cost considerations. For example, small cargo ships on short-haul routes may choose not to purchase cargo or ship insurance if the cargo owner and shipowner believe the risk is manageable.

 

Specific Vessels Require Oil Pollution Damage Civil Liability Insurance. According to relevant regulations, seagoing vessels and oil tankers of 1000 gross tons or more must purchase oil pollution damage civil liability insurance. This requirement stems from marine environmental protection needs, aiming to ensure that the responsible party has sufficient funds to cover cleanup and compensation costs after an oil pollution incident, reducing damage to the marine ecosystem. For example, if a 3000 gross-ton oil tanker leaks during transport without this insurance, it may face legal repercussions due to its inability to bear substantial compensation costs, potentially jeopardizing the company's survival.

 

While not mandatory, marine property insurance and personal accident insurance are required for maritime operations. Although not legally mandated, maritime authorities require vessels to purchase these insurances. This is because vessels face risks such as natural disasters, collisions, and groundings during navigation. Property insurance covers losses to the vessel and its equipment, while personal accident insurance covers crew injuries or fatalities caused by accidents. For example, if a cargo ship is damaged in a typhoon, hull insurance will cover repair costs; if crew members are injured, personal accident insurance will provide medical expenses and disability compensation. While not legally mandatory, failure to purchase these insurances can hinder port inspections and certificate processing, affecting normal operations.
